An 11-year-old boy has been awarded €10,000 after cutting his toe in a hotel swimming pool in Donegal.

The boy, who was 6 years old at the time, was staying with his family at the Redcastle Hotel in Inishowen on August 13, 2020.

The boy suffered a cut between his toes when he caught him on a tile near the pool.

The infant’s personal injury case was heard by Judge John Aylmer at Letterkenny District Court.

The boy’s lawyer, Patricia McCallum BL, told the court the boy was treated at Dungannon Hospital in Co Tyrone following the incident.

Orthopedic surgeon Aidan Lynch said the boy’s injury healed in four weeks, but he had been limping for five months and also had a half-inch scar on his fifth toe.

According to a report by psychiatrist Dr. Colin O’Donnell, the boy suffered from flashbacks and avoided swimming pools.

He confirmed that he was suffering from post-traumatic stress disorder, but that the prognosis was good.

The boy is now eleven years old, but was unable to come to court due to holidays.

Ms McCallum said the scar was “very small” and in a hidden spot between the boy’s toes.

She, along with Judge Aylmer, outlined the different levels of scar awards.

She said the dominant injury was the psychological injury inflicted on the boy.

Ms McCallum added that the scar was at the low end of the scale and the post-traumatic stress the boy suffered was at the low end of the scale.

After considering the offer, Judge Aylmer said he was happy to accept the offer of €10,000 in compensatory damages and €135 in special damages. He also awarded costs in the case.
